I'm not sure why you think the Empire is a Police State. It seems fairly free to me. People can travel about as they please, they can own personal weapons and even spacecraft with weapons. The Empire can't indescriminately kill people or shoot down spaceships (otherwise they wouldn't have to lie about taking the Tantive IV or fake the sandpeople attack on the Jawas).
Other the otherhand, in the Republic, the Jedis can pretty much do as they please. Dismember attempted murder suspects or tough talking bar patrols, interogate seriously wounded suspects without giving the suspect any medical treatment, slaughter sandpeople etc. But the Jedi never have to cover up these actions, they have complete and total police authority to do as they please; they just state that it is "Jedi business" and leave. -That- is closer to a police state than the Empire.
